Conditions of Consignment Contract: The Equine Company Performance Horse Sale and its associates act as agents and are not responsible for buyer and seller errors or misunderstandings. All representations and guarantees are strictly between the buyer and seller. Sellers are liable for any incomplete registration papers, transfers and certificates even if these errors are not noticed by The Equine Company Performance Horse Sale and its associates.

Horses will be sold as registered in the sale if all appropriate and required registration papers are received by April 24, 2008.

Fees: Consignment fees are non refundable and are due at the time the horse(s) are consigned. The consignment fee is $150.00 per horse and includes the use of one horse stall. Any consignment horse that demonstrates on cattle will be charged a $25.00 fee per horse.
The consignment commission will be 8% of the selling price. The consignor has the privilege to "no sale" or "pass out" his/her horse. There will be no fee assessed for this privilege. Consignors (Sellers) must pay all applicable fees before loading their horse(s).

Payment: All horses must be paid for the day of the sale. A 3% processing fee will apply to those parties paying by a check, debit or credit card. Credit cards accepted are MasterCard, Visa,  Discover and American Express. Checks written for an amount over $15,000.00 must accompany a current (30 days) bank letter of credit that is made out to "The Equine Company". The Equine Company Performance Horse Sale will mail sale proceeds to the consignor within (7) seven business days after the sale, less any other applicable or unpaid fees.

Bidding: Horses will be sold to the highest bidder. The auctioneer will settle any disputes or ties in  bidding. The auctioneer may decline any bids for reasons he/she deems appropriate. To obtain a buyers number a valid driver's license will need to be provided. Any announcements the day of the sale will take precedence over any printed information in the sale program. No sale transactions are allowed unless in the sale ring the day of the sale. All horses must go through the sale ring (auction).

Horse Health Papers: All horses brought on site must have a current (within the last 12 months) negative coggins test. This includes horses that are not in the sale but have brought to help in the demonstration sessions. Those horses that have been transported from out of state must have a health certificate from a practicing veterinarian and a permit. Health certificates MUST reflect the current coggins test.

Ownership: The buyer becomes responsible for the horse(s) purchased once the hammer falls by the auctioneer. No horse may leave the premise without a "paid" sales receipt or "release form" whether you are a buyer or seller (consignor).

Safety/Liability: The safety of all participants at the sale is of utmost importance to The Equine Company Performance Horse Sale. All horses must be stalled while at the sale for the safety of all attending. Parents are responsible for their children, and children should NOT be left unattended. All participants of the sale attend at their own risk. The Equine Company Performance Sale is NOT responsible for horses, any accidents, or loss of property at the sale. Prior arrangements must be made for any horse(s) left overnight at the sale location. Under Texas law (chapter 87, civil practice and remedies code) an equine professional is not liable for any injury to or death of a participant in equine activities resulting from the inherent risks of equine activities.

NOTE:  Original registration papers, transfers and any appropriate certificates must accompany a check of $150.00 for each horse. Make checks payable to "The Equine Company." Mail completed "Horse Consignment Data Sheet" & "Consignment Contract" to: 1317 W. Industrial Dr. Sulphur Springs, TX 75482 by April 24, 2008.
